AKELEY CITY COUNCIL
REGULAR MEETING
AUGUST 12, 2009
7:00 PM CITY HALL
The Akeley City Council met in a regular meeting Wednesday
August 12, 2009 at 7:00 pm. Acting Mayor Cliff Johnson called
the meeting to order. Council members present were: Troy Hegg
and Jennifer Mitchell. Scott Vettleson and Jon Johnson were
absent. The Pledge of Allegiance was recited by the Council and
attending audience.
Motion by Jennifer Mitchell seconded by Troy Hegg and carried to
approve the consent agenda consisting of the July regular
meeting minutes, the July 2009 treasurer’s report and the July
bills paid from check #5759 to check # 5871 including automatic
bank payments.
Cynthia Madigan was on the agenda to give an update on the U.S.
Census Bureau and activities but was not present.
Josh Kietzman from the C&C was present to give an update on Hay
Days which will be held on September 18th and 19th.
Lee Johnson was present from the EHCFD to discuss the fire
department gaming lease in which he proposed that the rent paid
to the liquor store would be lowered from 20% to 10%. He said
he would like to see the liquor store receive 10% and then 10%
go to the C&C who could then help out with Paul Bunyan Days and
other activities such as Hay Days. Roger Geimer stated that the
paperwork had to be turned in by August 31st so a
decision needed to be made one way or the other. The Council
decided to set a special meeting on Monday, August 17th
at 6:00 PM to review the request and make a decision at that
time.
Resolution #5-2009, Ordering Preparation of Report Broadway (TH
No. 34) Underground Utility Improvements was on the agenda to be
approved but was tabled indefinitely until the City gets more
information from the State of Minnesota.
Police Chief Eric Klein explained that the state has a new type
of administrative citation that the City can adopt if they
choose to. The difference between the old and new
administrative citations is that they are limited to speed
violations under 10 miles per hour in excess of the speed limit,
stop sign/stop line violations and equipment violations. The
fine is $60 and is dispersed with $20 going to the State, $20 to
the City and $20 to the Akeley Police Department. The police
department can still use the other administrative citations for
city ordinance violations but not for state traffic code
violations.
Motion by Jennifer Mitchell seconded by Troy Hegg and carried to
approve Resolution #6-2009, Administrative Citations for Traffic
Offenses.
Motion by Troy Hegg seconded by Jennifer Mitchell and carried to
approve Ordinance No. 05-09, An Ordinance Amending Chapter 91 of
the Akeley Code of Ordinances.
Motion by Troy Hegg seconded by Jennifer Mitchell and carried to
set a special meeting at 6:00 PM on August 17th
regarding the gambling rent percentage and to set a 2010 budget
work session at 6:30 PM on August 17th.
Motion by Jennifer Mitchell seconded by Troy Hegg and carried to
approve the City’s 2009-2010 winter propane contract with
Skelgas of Park Rapids at $1.29 per gallon.
Cliff Johnson read a letter from Frank Lamb, President of the
Paul Bunyan Historical Society which stated at the annual
meeting of the Historical Society they voted to allow up to
$7,000 towards new bathrooms in the area of Paul’s Patio. Frank
said in the letter that he hoped the City would get some
estimates and continue with the project. The letter is on file
at City Hall. Frank Thelin stated that the water line and sewer
line locations have to be considered if new bathrooms are to be
built.
Motion by Troy Hegg seconded by Jennifer Mitchell and carried to
table a decision to build bathrooms in the Paul’s Patio area
until the possibilities can be looked into.
Liquor Store Report – Bob Winner
Motion by Jennifer Mitchell seconded by Troy Hegg and carried to
approve to pay the bands for the local band showcase from the
liquor fund.
Water/Sewer/Maintenance Report - Frank Thelin

Frank said holes
on 2nd Street and Hulet and part of the beach
road had been cold packed and said he is hoping to get more
roads patched. The cold patch material was furnished by MN
DOT.

The sewer pond
weeds were eliminated in order to be in compliance with MN
Pollution Control Agency.
Part-time maintenance help was on the agenda but the council
thought that it could be discussed during the 2010 budget work
session set for August 17th.
Police Report - Eric Klein

Eric said he has received numerous complaints
regarding the crosswalks near the bank and by the 1st
Lutheran Church since they are not visible and it is difficult
for pedestrians to cross the streets at those intersections.
Frank Thelin said that he and Tim Scouton would get them
painted.

Eric requested Council permission to allow the
curbs to be painted yellow on Highway 64 South in the area by
T&M due to the number of parking complaints and the narrowness
of the highway. He said that MN DOT is OK with the curbs being
painted. Suggestions were to see if Hubbard County STS people
could do the painting or community service people who owe time
to the City.

There have been reports of illegal dumping near 11th
Crow Wing Lake and the Council discussed what the fine should be
since the ordinance states that the penalty which may be imposed
for any crime which is a misdemeanor shall be a sentence of not
more than 90 days or a fine of not more than $1,000 or both.
Motion by Jennifer Mitchell seconded by Troy Hegg and carried to
approve that the penalty for illegal dumping on the 1st
offense shall be $350 and the maximum penalty of $1,000 shall
apply to the 2nd offense.

Eric stated that there were 37 kids and several
adults taking part in the police sponsored “Take A Kid Fishing
Day”. He thanked the Akeley Lions and many businesses who made
donations, as well as to Greg Poncelet, Matt McCollough and
Travis Carlson who gave of their time and efforts to make this
event happen.
Old Business
Bob
Winner stated that he and Mayor Vettleson both thought the new
security system at the liquor store was a good idea. Cliff
Johnson stated he thought a decision should be made when the
mayor is here. Bob Winner also stated that he thought it would
be a good idea to have security present during the Audrey’s
Purple Dream fund raiser and the local band showcase.
Various citizens were present to speak on Travis Carlson’s
behalf in hopes that the Council would reconsider hiring him as
a part-time police officer since the decision had been tabled at
the July council meeting. Denise Rittgers said she wanted
everyone to understand that as a reserve officer Travis could
volunteer his time but being employed by the City of Akeley he
could no longer volunteer his time per the League of Minnesota
Cities.
Motion by Jennifer Mitchell seconded by Troy Hegg and carried to
approve to sponsor Travis Carlson as a part-time police officer
at the rate of $12 per hour for the City of Akeley.
New Business
Cliff Johnson read a letter from C&C President Don Wicks, who
stated that the C&C is handing over the ownership of the Paul
Bunyan Statue to the City of Akeley. It had been the belief
that the City assumed ownership but there was no paperwork to be
found stating this.
Motion by Jennifer Mitchell seconded by Troy Hegg and carried to
accept ownership of the Paul Bunyan Statue from the C&C.

adjourn at 8:10 PM.
